Terms of Service

Welcome to BookPace. By downloading, installing, or using the BookPace mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using BookPace, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and BookPace.

2. Description of Service

BookPace is a reading time tracking application that allows users to:

Track reading time for books and reading sessions
Manage reading statistics and progress
Use NFC tags for physical book tracking (Premium feature)
Access widgets and Live Activities for reading timers
Enable focus mode to block distractions while reading

3. User Accounts and Data

The App stores your reading data locally on your device. If you enable iCloud sync, your data will be synced across your devices using your iCloud account. You are responsible for maintaining the security of your device and Apple ID.

4. Premium Subscriptions

BookPace offers premium subscription plans with enhanced features:

Payment: Subscriptions are charged through your Apple ID account and processed through the App Store.
Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Cancellation: You can cancel your subscription at any time through your App Store account settings.
Refunds: Refunds are handled by Apple according to their policies. We cannot provide refunds directly.
Price Changes: We reserve the right to modify subscription prices. Changes will not affect current subscribers until their next renewal period.
Manage Subscription: Manage or cancel at any time in Settings > [your name] > Subscriptions on your device.
Renewal Charge Timing: Your account may be charged for renewal within 24 hours before the end of the current period.
Trials: If offered, any unused portion of a free trial period is forfeited when you purchase a subscription.
Price Increases: If prices change, Apple may notify you and request consent; if you do not agree, your subscription will not renew at the new price.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You may not:

Attempt to reverse engineer, decompile, or disassemble the App
Use the App in any way that violates any applicable laws or regulations
Attempt to gain unauthorized access to any part of the App or its systems
Use the App to transmit harmful code, viruses, or malicious software

6. Intellectual Property

The App and its original content, features, and functionality are owned by BookPace and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Third-Party Services

The App may integrate with third-party services, including:

Apple StoreKit for in-app purchases
Apple CloudKit for iCloud synchronization
Apple NFC framework for NFC tag reading

Your use of these services is subject to their respective terms and conditions.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKPACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

13. Apple EULA

If you obtained the App through the App Store, your use of the App is also subject to Apple’s Standard EULA: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, and the Apple Media Services Terms and Conditions: https://www.apple.com/legal/internet-services/itunes/us/terms.html.
